Generally, there is a right to litigate a dispute by raising an action in court.

When all other options have been exhausted, or if it is more appropriate, a dispute can be litigated by raising an action in court. An action can be raised either in the sheriff courts, or in the Court of Session.  Certain types of dispute can only be raised in the Court of Session.

Sometimes it may be appropriate to raise an action in court at the outset of a dispute. Other times, it may become apparent at a later stage that there is no better way of resolving the issue.
