Expert determination can be time-saving and cost-effective. An expert can use their own knowledge and experience to reach a decision, but cannot determine a question of law. The expert is also able to investigate the matter as they please. Unless the parties agree otherwise, the decision will be binding. This method of dispute resolution can also be used in the context of litigation.
Expert determination is particularly suitable where there is a discrete argument of fact between the parties, such as the quality of works undertaken.
